Terms of Use
These terms govern access to, browsing of and use of chiptuner.net. By using the site the user accepts these terms, without prejudice to the rights granted by any mandatory law that applies.

1. Purpose
This document sets out the rules for accessing and using chiptuner.net, its content, user areas, forms, tools and other features. Specific terms for a product or service, where they exist, supplement these terms and prevail over them for that product or service in the event of a conflict.

3. Acceptance and capacity
Accessing and browsing the site implies acceptance of these terms. To create an account or place an order the user must have sufficient legal capacity. Anyone acting on behalf of a company or another person declares that they are authorised to represent them.
If you do not agree with these terms, you must stop using the site.
4. Access, account and availability
General access to the website is free of charge, without prejudice to the price of the products or services purchased. Some features may require registration.
The user must provide accurate information, keep it up to date and protect their credentials. They are responsible for activity carried out from their account where it results from a lack of care in keeping those credentials safe. They must notify info@chiptuner.net without delay if they suspect unauthorised access.
CHIPTUNER S.L. may temporarily limit or suspend the site or any feature for maintenance, security, technical reasons, force majeure or legal compliance. We aim to keep the impact of such interruptions low, but uninterrupted availability is not guaranteed.
5. User obligations
The user undertakes to:
- use the site lawfully, carefully and in good faith;
- provide truthful information and not impersonate third parties;
- respect the rights of CHIPTUNER S.L. and of third parties;
- make sure they are entitled to supply the files, technical data, vehicle information and other materials they send;
- check that the product or service chosen is compatible with and suitable for the intended use;
- keep backups of the relevant files and configurations before making any technical modification;
- comply with the rules applicable to the vehicle, equipment, professional activity and territory where the product or service is used.
6. Prohibited uses
The following are prohibited:
- using the site for unlawful or fraudulent activities or activities that harm the rights of third parties;
- introducing malware, attempting unauthorised access or interfering with the security or availability of the service;
- mass data extraction, unauthorised automated scraping, attacks, unconsented vulnerability testing or reverse engineering of the site;
- copying, distributing, modifying or exploiting content, software, databases or materials without authorisation;
- circumventing access controls, licences, technical limits or security mechanisms;
- using identities, data, vehicles, accounts, files or payment methods belonging to third parties without authorisation;
- reselling, sublicensing or sharing files, calibrations, licences or content where the contract or the licence does not allow it.
7. Technical information and use of products or services
The information published on the site is general in nature and does not replace a technical assessment of the specific vehicle or equipment. The results of a calibration, programming or modification may vary depending on mechanical condition, servicing, fuel, fitted components, the original software, the operating environment and other external factors.
The user must supply complete and correct information and follow the applicable technical instructions. Unless expressly agreed in writing, no specific power, torque, consumption or other figures are guaranteed.
Certain modifications may affect type approval, emissions, roadworthiness testing, the manufacturer's warranty, insurance or authorisation to drive on public roads. The customer is responsible for checking and complying with the applicable rules and for using products or configurations identified for that purpose exclusively in competition, on a closed circuit or off the public road.
Slave-version tools supplied by CHIPTUNER S.L. are technically linked to the CHIPTUNER master equipment and file service: such a tool exchanges files only through the CHIPTUNER infrastructure and cannot be used with another file provider. Unlinking or transferring the tool is possible only with the intervention of CHIPTUNER S.L. This link is a technical characteristic of the product and is disclosed before purchase.
Nothing in this clause limits mandatory consumer rights or any liability that cannot lawfully be excluded.
8. Intellectual and industrial property
The texts, trade marks, logos, designs, photographs, videos, databases, code, software, documentation, files, calibrations and structure of the site belong to CHIPTUNER S.L. or to its respective licensors and are protected by the applicable law.
Accessing the website transfers no ownership rights and grants no exploitation licence, other than the limited, personal, revocable and non-exclusive right needed to make legitimate use of the site and of the products or services purchased under their terms.
Third-party trade marks and content belong to their owners. Their appearance implies no sponsorship, association or authorisation beyond what is expressly stated.
9. Materials sent by the user
The user keeps whatever rights they hold over the files and materials they send. By supplying them, they authorise CHIPTUNER S.L. and the necessary providers to host, analyse, technically adapt and use them to the extent strictly needed to prepare a quote, perform the contract, provide support, investigate an incident or meet legal obligations.
The user warrants that sending and processing those materials infringes no third-party rights. CHIPTUNER S.L. may reject or delete unlawful or malicious materials or materials unrelated to the purpose of the service.
10. Third-party links and services
The website may contain third-party links, gateways or integrations. CHIPTUNER S.L. does not control their content, availability or policies and is not liable for them, except where the law expressly assigns liability. The user should review the third party's terms and policies before using its service.
11. Dealer network
CHIPTUNER products and services are also offered through a network of dealers. Dealers are independent businesses that act in their own name and for their own account. They are not employees, agents, branches or joint ventures of CHIPTUNER S.L. and have no authority to enter into obligations on its behalf.
The designations "official dealer" and "certified dealer" mean only that the dealer has been trained by CHIPTUNER S.L. and is authorised to order and install its calibrations. They create no other legal relationship.
Work performed on the vehicle at a dealer — including diagnostics, disassembly and assembly, installation of the calibration and any mechanical work — is contracted directly between the customer and the dealer, under the dealer's own terms and prices. Claims relating to that work, to the handling of the vehicle or to the dealer's service are addressed to the dealer.
The responsibility of CHIPTUNER S.L. is limited to the firmware calibration it supplies. The calibration result guarantee covers the calibration itself and is governed by the conditions published on the site.
Nothing in this clause limits mandatory consumer rights or any liability that cannot lawfully be excluded.
12. Liability
CHIPTUNER S.L. takes reasonable measures to keep the website secure and up to date, but does not guarantee that it is permanently free from errors, interruptions or harmful elements.
To the fullest extent permitted by law, CHIPTUNER S.L. is not liable for indirect damage, loss of opportunity, loss of data or loss of profit arising from use contrary to these terms, from incorrect information supplied by the user, from incompatibilities that were not reported, from third-party intervention or from failure to follow technical instructions.
This limitation does not apply in cases of wilful misconduct, gross negligence, infringement of mandatory consumer rights, personal injury or any other case where liability cannot lawfully be limited.
13. Data protection and cookies
The processing of personal data is governed by the Privacy Policy. The use of cookies and similar technologies is explained in the Cookie Policy. Both form part of the framework for using chiptuner.net.
14. Suspension for breach
CHIPTUNER S.L. may block an account or restrict access where there are reasonable grounds to suspect fraud, a security risk, non-payment, infringement of rights, prohibited use or breach of these terms. Where reasonable and legally possible, the user will be informed and given the chance to clarify the situation.
15. Amendments and validity
CHIPTUNER S.L. may update these terms to reflect legal, technical or functional changes. The version in force is the one published on this page. Changes have no retroactive effect on rights already acquired, unless a rule or the nature of the change requires otherwise.
16. Governing law and jurisdiction
These terms are governed by Spanish law.
Where the user acts as a consumer, any dispute is submitted to the courts having jurisdiction under consumer law, including, where applicable, the court of their domicile.
In relations between professionals or businesses, the parties submit, unless a mandatory rule or a different written agreement applies, to the courts of Málaga, Spain.
